Top Causes of On-the-Job Injuries in Illinois

In 2020, Illinois employers reported 106,900 total workplace injuries throughout the state. On-the-job injuries occurred at a rate of about 2.7 injuries per 100 full-time workers.

Many of these injuries did not interfere with the worker’s ability to continue working. In over 54,000 cases, however, an injured person needed to take at least one day off work to recover from their injury. Nearly 20,000 workers had to accept a transfer to a new job or restrictions on their job duties until they healed. These rates were slightly higher than the rates for the United States as a whole – suggesting that when Illinois workers get injured, their injuries tend to be serious.

Top causes of workplace injuries in Illinois, according to the U.S. Bureau of Labor Statistics (BLS), include:

  • Falls, including both falls at the same level and falls from a height.
  • Being struck by equipment or materials, including auto accidents, falling objects, and other injuries.
  • Entrapment between two objects or items, including body parts pinned inside machines or being stuck between two items.
  • Burn injuries, including thermal, chemical, electrical, and radiation burns.

Other types of serious injuries can also occur at work. Often, how a person is injured on the job depends on the work they do and the hazards they face.

Common Injuries Suffered in Workers’ Compensation Claims

The top causes of workplace injuries can cause serious harm to workers. Common types of injuries suffered at work include:

Traumatic Brain Injuries

Brain injuries can occur on the job from a blow to the head, an object that pierces the skull, lack of oxygen, and other causes. In the workplace, traumatic brain injuries may occur due to a fall, being struck by an object, hitting the head on an object or surface, or from other causes. Even a mild brain injury can cause ongoing problems with concentration, mood, and memory. Physical symptoms like headaches, dizziness, and nausea may also persist.

Spinal Cord Injuries

Spinal cord injuries are among the most expensive, difficult-to-treat injuries. A spinal cord injury may be “complete,” meaning the spinal cord is severed. An “incomplete” spinal cord injury occurs when the spinal cord is damaged, but not completely cut. Complete spinal cord injuries typically result in paralysis below the injury site, while incomplete injuries can result in paralysis, loss of coordination or muscle control, loss of sensation, and other problems.

Broken Bones

Broken bones are a common type of on-the-job injury. While they are commonly associated with construction, manufacturing, and agricultural work, a broken bone can occur in nearly any work setting. Falls, being struck by objects, and other common on-the-job injury scenarios can result in broken bones. Some broken bones require surgery to correct, and all breaks require time and rest to heal. Chronic pain and limited mobility may persist even after bones have healed.

Exposure-Related Injuries

Exposure to excessive heat or cold can cause severe injuries. In some cases, exposure to extreme temperatures can result in death. Similarly, exposure to chemicals and other substances can cause injury and occupational illness. While some exposure injuries are obvious when they occur, others take years to develop – making a workers’ compensation claim more complicated.

Burn Injuries

Burn injuries can come from several sources. Common types of burn injuries include:

  • Thermal burns from fire or other heat sources,
  • Chemical burns from exposure to strong chemicals,
  • Electrical burns from an electrical shock or current,
  • Radiation burns from radioactive materials or sources, and
  • Friction burns, commonly known as “road rash,” from rubbing against a surface.

Workplaces with high risks of burns are typically required to follow regulations to warn workers and reduce the risk of injuries. Burns may occur in any workplace, however, if care isn’t taken to follow safety procedures and instructions on the equipment. Defective equipment or tools can also result in burns or other injuries.

What to Expect During an Illinois Workers’ Compensation Case

Workers’ compensation claims follow rules laid out by the state workers’ compensation commission. These rules include explanations of the benefits available under workers’ compensation law.

In some cases, an injured person may have a legal claim against a party other than their employer or the workers’ compensation insurer. Known as third-party claims, these cases can be a valuable source of compensation.

Benefits Available Through Workers’ Compensation in Illinois

Workers’ compensation pays several different types of benefits to employees who are injured on the job in Illinois.

Medical Benefits

Medical benefits cover medical care related to your on-the-job injury. Hospital visits, doctors’ appointments, medications, medical equipment, and other expenses are covered by medical benefits.

Temporary Total Disability (TTD) Benefits

Temporary total disability benefits help an injured employee make ends meet if they must take time off work to recover from their injury. These benefits are calculated according to a formula provided by the state workers’ compensation commission. They are typically paid for only a short period of time.

Temporary Partial Disability (TPD) Benefits

Temporary partial disability benefits compensate injured employees who can do some work, but who must be restricted to light duty while they are healing. The amount the employee earned in their regular job and the amount they’re earning in the light-duty job are both included in the calculation of these benefits.

Vocational Rehabilitation and Maintenance Benefits

These benefits help workers who need to retrain or find a new position as a result of their injuries. They include job counseling, job search assistance, and vocational retraining, including college or technical school courses where appropriate.

Permanent Disability Benefits

Both permanent partial disability (PPD) and permanent total disability (PTD) benefits compensate employees who suffer permanent disabilities as a result of their on-the-job injury. These benefits are calculated according to specific rules laid out by the state of Illinois. The type of injury and the injured person’s previous and current wages are included in the calculation.

Death Benefits

If an employee’s workplace injuries prove fatal, their surviving family members are entitled to receive death benefits from workers’ compensation. These benefits can help the family meet funeral and burial expenses, as well as other expenses related to the loss.

While all these benefits are available to all employees who qualify for workers’ compensation coverage, not every employee needs every type of benefit each time. If your injury heals fully and you can return to your usual job, for instance, you may not need permanent total disability benefits.

Third-Party Claims: When Someone Outside Work Cause Your Injuries

Workers’ compensation insurance pays benefits without asking about fault. Employees injured on the job are entitled to benefits, whether they caused their injury or their employer did.

In some cases, however, neither the worker nor the employer is at fault for the injury. Instead, a third party is responsible. Examples of third-party cases include:

  • While making a work-related delivery, you were struck by a drunk driver.
  • A hidden defect in a tool you use for work caused the tool to overheat, injuring you.
  • Repair workers hired to fix the steps in your office did the job incorrectly, causing you to trip and suffer injury.

Other types of third-party cases may also occur. In a third-party case, you may be able to bring a lawsuit against the third party for their negligence in addition to collecting workers’ compensation benefits. An experienced Orland Park workers’ compensation attorney can help you determine if you have a third-party claim and seek the compensation you deserve.
