Chicago Penske Truck Accident Lawyer

A Penske truck collision can happen in seconds, but the injuries and financial damage it causes can last for years. Whether you were hit near the I-290 interchange, on the Kennedy Expressway, or at an intersection in the Loop, a collision with one of these large rental trucks raises serious legal questions about who is responsible and how you can recover fair compensation. Briskman Briskman & Greenberg, located at 205 W Randolph St., Suite 925, Chicago, IL 60606, represents injured people throughout the Chicago area in truck accident claims, including those involving Penske rental trucks.

Table of Contents

Penske trucks are large commercial rental vehicles, often used for business moves, freight hauling, and long-distance deliveries. They share the road with passenger cars on some of Chicago’s busiest corridors, including I-90/94, I-55, and Lake Shore Drive. When one of these trucks is involved in a crash, the injuries tend to be serious. A fully loaded Penske truck can weigh tens of thousands of pounds, and the force of impact in a collision is nothing like a typical car accident.

What makes these cases legally distinct is the question of who actually operated the truck and under what circumstances. Penske trucks are rented by businesses and individuals. The driver might be a company employee, a private mover, or a hired contractor. Each of those situations creates a different legal relationship and potentially a different set of liable parties.

As a Chicago personal injury lawyer familiar with commercial vehicle claims knows, the at-fault driver is rarely the only party responsible. The company that rented the truck, the business that loaded the cargo, and even Penske itself may share responsibility depending on the facts. Illinois follows a modified comparative fault rule under the Illinois Code of Civil Procedure, which means you can recover damages as long as you are not more than 50% at fault for the crash. Your compensation is reduced by your percentage of fault, but you are not automatically barred from recovery.

Penske, as a national fleet operator, is subject to federal regulations from the Federal Motor Carrier Safety Administration (FMCSA), the agency within the U.S. Department of Transportation responsible for setting safety standards for commercial motor vehicles. Depending on the truck’s weight and use, the driver and the company may also be required to comply with FMCSA regulations governing driver qualifications, vehicle maintenance, and hours of service.

Federal Regulations That Apply to Penske Truck Drivers and Operators

Federal law sets clear rules for how large commercial trucks must be operated. The FMCSA’s Hours of Service (HOS) regulations define the maximum amount of time drivers are permitted to be on duty, including driving time, and apply to all carriers and drivers operating commercial motor vehicles under 49 CFR Part 395. These rules exist because fatigued drivers are dangerous drivers, and large trucks require full alertness to operate safely.

One of the most frequently cited HOS violations is exceeding the 11-hour driving limit under 49 CFR 395.3(a)(3), which states that property-carrying commercial motor vehicle drivers may not drive more than 11 hours after 10 consecutive hours off duty. When a Penske driver violates this rule and causes a crash, that violation becomes powerful evidence of negligence in a civil claim.

FMCSA also requires drivers to take an off-duty, sleeper berth, or on-duty non-driving 30-minute break after driving for 8 cumulative hours, as stated in 49 CFR 395.3(a)(3)(ii). A driver who skips that break and then causes a crash near the Eisenhower Expressway or on the Dan Ryan has violated a federal safety rule that directly supports a negligence claim against them and the company that sent them out.

Motor carriers are also required under 49 CFR 390.15 to maintain a register of all crashes that occurred in the past three years. That register must contain, at minimum, the date of the crash, the city or town and state most near where the crash occurred, the driver’s name, and the number of injuries or fatalities. This crash history can reveal a pattern of unsafe driving that strengthens your case.

If the Penske truck involved in your crash was operating as a commercial motor vehicle under federal definitions, the full weight of FMCSA regulations applies. A truck accident attorney who understands these federal rules can use them to build a case that holds every responsible party accountable.

Who Can Be Held Liable After a Penske Truck Accident in Chicago

Liability in a Penske truck accident is rarely limited to one person. Multiple parties often share responsibility, and identifying all of them is critical to recovering full compensation.

The driver is the most obvious starting point. If the driver was speeding, distracted, fatigued, or otherwise negligent, they can be held personally responsible. This is true whether the driver was a private individual who rented the truck for a move or an employee of a business using Penske for freight.

The company or individual that rented the truck may also be liable. Under Illinois negligence law, an employer can be held responsible for the negligent acts of an employee who was acting within the scope of their employment. This is called respondeat superior, a legal doctrine that holds employers accountable for their workers’ on-the-job conduct. If a business rented a Penske truck and their employee caused your crash while making a delivery in River North or hauling equipment through Bridgeport, that business is a potential defendant.

Penske itself may bear responsibility in certain situations. If the truck was improperly maintained, had defective brakes, or had faulty lighting that contributed to the crash, Penske’s maintenance practices come into question. All carriers involved in an FMCSA-reportable crash must retain an accident register, and a reportable crash is one in which a vehicle was towed from the scene or an injury or fatality occurred. Penske’s records can be subpoenaed to examine the truck’s maintenance history and prior incidents.

Third parties, such as cargo loaders or mechanics, can also be liable if improper loading or faulty repairs contributed to the crash. A truck accident lawyer with experience in commercial vehicle cases will investigate every possible avenue to ensure no liable party is overlooked.

What Damages You Can Recover in a Chicago Penske Truck Accident Claim

Illinois law allows injured people to seek compensation for the full range of harm caused by someone else’s negligence. If a Penske truck crash left you with broken bones, spinal injuries, a traumatic brain injury, or other serious harm, you have the right to pursue damages that reflect the real impact on your life.

Economic damages cover the financial losses you can document. These include all past and future medical bills, costs for physical therapy and rehabilitation, lost wages while you were unable to work, and reduced earning capacity if your injuries affect your ability to work long-term. A serious crash can generate hundreds of thousands of dollars in medical expenses alone, especially when surgery, hospitalization, and ongoing care are involved.

Non-economic damages cover the human cost of the injury. Pain and suffering, emotional distress, loss of enjoyment of life, and loss of consortium for a spouse or family member are all recoverable under Illinois law. These damages can be significant in cases involving permanent injury or disfigurement.

In some cases, punitive damages may be available. Illinois courts can award punitive damages when the defendant’s conduct was willful and wanton, meaning they acted with reckless disregard for the safety of others. If a Penske driver was driving while impaired or had been awake for an unsafe number of hours with the company’s knowledge, that may support a punitive damages claim.

If your injuries were fatal, the Illinois Wrongful Death Act, found at 740 ILCS 180/2, allows the personal representative of the deceased person’s estate to bring a claim for the benefit of surviving family members. Under 740 ILCS 180/2, the action is brought by the personal representative of the deceased person for the exclusive benefit of the surviving spouse and next of kin, and it generally must be commenced within two years after the death. The attorneys at Briskman Briskman & Greenberg can help surviving families understand and pursue these claims.

The Illinois Filing Deadline for Penske Truck Accident Claims

Time is one of the most important factors in any truck accident case. Illinois law sets a strict deadline for filing a personal injury lawsuit, and missing it means losing your right to recover compensation permanently.

In the state of Illinois, the statute of limitations for most personal injury claims is two years from the date of the injury, which is specified in the Illinois Compiled Statutes, section 735 ILCS 5/13-202. This two-year window applies to Penske truck accident claims just as it applies to other motor vehicle injury cases.

Individuals who do not file a lawsuit within the two-year deadline will be unable to take legal action and pursue compensation for any injuries and damages resulting from the accident. Illinois courts apply this deadline strictly. There is no grace period for being close to the deadline.

There are limited exceptions. For some cases and certain circumstances, there may be exceptions and extensions to the deadline. Under the discovery rule, in some personal injury cases, the injured party may be unaware of their injuries at the time they occur. In those situations, the clock may start when the injury was discovered or reasonably should have been discovered.

Beyond the statute of limitations, evidence disappears quickly. Surveillance footage from businesses along Milwaukee Avenue or Wacker Drive gets overwritten within days. Electronic logging device data from the Penske truck, which records the driver’s hours and driving patterns, must be preserved immediately. Motor carriers are required to maintain a register of all crashes that occurred in the past three years under 49 CFR 390.15, but other records may not be kept that long. Acting quickly protects your ability to build a strong case.

FAQs About Chicago Penske Truck Accidents

Is Penske responsible if one of their rental trucks hits me?

Penske may share responsibility depending on the circumstances. If the crash was caused by a mechanical defect or improper maintenance of the truck, Penske’s liability as the vehicle owner and maintenance provider comes into question. If the driver or the company that rented the truck was negligent, they may be primarily liable. An attorney can investigate the specific facts to determine which parties can be held accountable.

What if the Penske truck driver was not a commercial driver?

Many Penske trucks are rented by private individuals or small businesses whose drivers do not hold commercial driver’s licenses. This does not eliminate your right to compensation. The driver’s negligence, the renting company’s negligence, and Penske’s maintenance practices are all still subject to scrutiny. Illinois negligence law applies regardless of whether the driver held a commercial license.

How long does a Penske truck accident case take to resolve in Illinois?

The timeline varies depending on the severity of the injuries, the number of liable parties, and whether the case settles or goes to trial. Cases involving serious injuries often take longer because it is important to understand the full extent of medical costs and long-term impact before settling. Some cases resolve within months through negotiation, while others may take a year or more if litigation is necessary.

Can I still recover compensation if I was partly at fault for the Penske truck crash?

Yes, in most situations. Illinois follows a modified comparative fault rule. As long as you are found to be 50% or less at fault for the crash, you can still recover damages. Your total compensation is reduced by your percentage of fault. For example, if you were found to be 20% at fault and your total damages are $200,000, you would recover $160,000. An attorney can help present the facts in a way that accurately reflects the other party’s greater share of responsibility.

What evidence is most important in a Penske truck accident case?

The most valuable evidence includes the truck’s electronic logging device (ELD) data, which records the driver’s hours and driving behavior; the truck’s maintenance and inspection records; the crash report from the Chicago Police Department; surveillance footage from nearby businesses or traffic cameras; witness statements; and your medical records documenting the full extent of your injuries. This evidence needs to be preserved quickly, which is one of the strongest reasons to contact an attorney right away after a crash.
