These are calculated based on your average weekly wage under Section 10 of 820 ILCS 305, which uses your actual earnings over the 52 weeks before your injury, excluding overtime and bonuses, divided by 52. If your injury leaves you with a lasting impairment, you may also be entitled to Permanent Partial Disability (PPD) or Permanent Total Disability (PTD) benefits. In the most serious cases, such as a traumatic brain injury, spinal cord damage, or catastrophic burns, these benefits can be substantial and long-lasting.

Filing Deadlines Every Belleville Worker Must Know

Deadlines in Illinois workers’ compensation cases are strict. Under 820 ILCS 305/6(d), a claim must be filed within three years of the date of the accident where no compensation has been paid, or within two years after the date of the last payment of compensation where any has been paid, whichever is later. When a Third Party Is Also Responsible for Your Injury

Workers’ compensation is not always the only avenue for recovery. In some situations, a party other than your employer may share responsibility for your injury, and that opens the door to a separate civil claim. For example, if a defective piece of equipment caused your injury, the manufacturer may be liable. If a negligent driver struck you while you were making deliveries on the job, you may have a claim against that driver in addition to a workers’ comp claim.
