Chicago Truck Trailer Detachment Accident Lawyer

A truck trailer that breaks free from its cab is not just a mechanical failure, it is a catastrophic event. On Chicago’s busy expressways, like the I-90/94 Dan Ryan Corridor or the I-290 Eisenhower, a detached trailer can crush multiple vehicles, block lanes, and kill people in seconds. If you or someone you love was hurt in this type of crash, you need to understand your legal rights, who can be held responsible, and why time matters. The attorneys at Briskman Briskman & Greenberg, a Chicago personal injury lawyer firm, are ready to help you pursue the full compensation you deserve.

What Causes Truck Trailer Detachment Accidents in Chicago

Trailer detachment happens when the connection between a semi-truck’s cab and its trailer fails during travel. The most common connection point is the fifth-wheel coupling, a large plate-and-pin mechanism that locks the trailer to the tractor. When that coupling is defective, worn, or improperly engaged, the trailer can separate at highway speeds.

Maintenance failures are a leading cause. Under 49 CFR Part 396, it is the duty not only of the truck driver, but also the officers, agents, representatives, and employees of a motor carrier who are “directly concerned” with the inspection or maintenance of the vehicle to make sure it is road-worthy before the driver gets behind the wheel. When a carrier skips required inspections or ignores worn coupling hardware, they are breaking federal law.

Driver error also plays a role. A driver who fails to perform a proper pre-trip inspection may not catch a loose kingpin or a damaged locking jaw before pulling out of a loading dock. Chicago’s industrial corridors, including the stretch along Cicero Avenue and the freight routes near the Pilsen neighborhood, see heavy commercial traffic daily. Any one of those trucks could be operating with a coupling that was never properly secured.

Defective parts are another factor. A manufacturer that produces a faulty fifth-wheel assembly, or a repair shop that installs one incorrectly, can also share responsibility for the resulting crash. The chain of liability in a trailer detachment case often runs through multiple parties, not just the driver.

Weather conditions on Chicago roads can worsen an already compromised connection. Ice on the I-55 Stevenson Expressway or sudden braking on the I-94 Tri-State can stress a coupling that was already close to failure, causing it to give way entirely.

Federal and Illinois Laws That Govern Trailer Coupling Safety

Federal law sets the baseline for trailer safety across all states, and Illinois adds its own requirements on top. Both sets of rules apply to most commercial trucks operating in and around Chicago.

Regulations issued by the Federal Motor Carrier Safety Administration (FMCSA) are published in the Federal Register and compiled in the U.S. Code of Federal Regulations (CFR). The FMCSA’s vehicle safety standards, found in 49 CFR Part 393, cover every safety-critical component on a commercial truck, including coupling devices. Under 49 CFR Part 393.70, towing and coupling devices must be properly installed, maintained, and free from defects that could cause separation.

Under 49 CFR Part 396, it is the duty of the motor carrier and its employees directly concerned with inspection or maintenance to ensure vehicles are road-worthy before operation, and there must be routine and organized inspections, things must be maintained, and things must be repaired or replaced as needed to keep everyone safe.

On the Illinois side, the Illinois Vehicle Code, 625 ILCS 5, governs commercial drivers operating within state lines. Illinois does not apply a strict negligence per se doctrine that automatically imposes liability for any statute violation. Instead, violating a statute or ordinance designed to protect human life or property is treated as prima facie evidence of negligence when the violation proximately causes the injury. This means that proof of a federal or state safety violation is powerful evidence in your civil case.

Commercial motor vehicles are required to carry substantially more liability coverage than private passenger vehicles. Under 49 CFR 387, motor carriers transporting general freight must maintain a minimum of $750,000 in liability coverage, and for hazardous materials, that floor rises to $5,000,000. These higher policy limits exist because the damage a runaway trailer can cause is enormous.

Who Can Be Held Liable After a Trailer Detachment Crash in Illinois

Liability in a trailer detachment accident rarely falls on just one party. Illinois law allows injured victims to pursue claims against every party whose negligence contributed to the crash.

The truck driver is an obvious starting point. A driver who skips a pre-trip inspection or ignores a warning sign during a trip can be held personally liable. But the trucking company behind that driver often carries deeper responsibility. The company is legally accountable for the actions of its employee while on duty. Beyond that, carriers may face additional direct claims, including negligent hiring if the driver had a disqualifying record, negligent retention if a dangerous pattern emerged during employment, and negligent maintenance if the vehicle failed to meet the roadworthy standards required by 49 CFR 396.

Third-party maintenance contractors can also be liable. If a repair shop serviced the fifth-wheel coupling and did the job incorrectly, that shop may share responsibility for the detachment. The same applies to a parts manufacturer whose defective coupling hardware failed under normal operating conditions.

Illinois law specifically addresses how damages may be allocated when more than one party bears responsibility. Under 735 ILCS 5/2-1117, defendants found liable in qualifying bodily injury or death cases are jointly and severally liable for the plaintiff’s past and future medical and medically related expenses. For other damages, a defendant whose fault is less than 25% of the total fault is generally severally liable, while a defendant whose fault is 25% or greater is generally jointly and severally liable.

Illinois also follows a modified comparative negligence system. If you are found to be partially at fault, your compensation is reduced by your percentage of fault. As long as your share of fault is less than 51%, you can still recover damages.

An experienced truck accident lawyer will investigate all possible defendants, not just the most obvious one, to build the strongest possible case on your behalf.

What Compensation Can You Recover After a Trailer Detachment Accident

A trailer detachment accident can leave victims with life-altering injuries. Crushed vehicles, rollovers, and multi-car pileups are common outcomes. Injuries in serious trucking crashes frequently include traumatic brain injuries, spinal cord damage, multiple fractures, long-term disability, and wrongful death, losses that can far exceed what standard auto insurance is designed to cover.

Illinois personal injury law allows victims to seek both economic and non-economic damages. Economic damages include medical bills, future medical care, lost wages, and reduced earning capacity. Non-economic damages cover pain and suffering, emotional distress, and loss of enjoyment of life.

If a loved one was killed in a trailer detachment crash, the Illinois Wrongful Death Act, 740 ILCS 180, allows surviving family members to pursue a wrongful death claim. Wrongful death claims follow a separate statute, 740 ILCS 180/2, which runs two years from the date of death rather than the date of the crash itself.

Do not accept an early settlement offer without legal guidance. Higher policy limits do not mean the money flows easily. Carriers employ experienced claims teams whose job is to minimize payouts. An early settlement offer from a carrier’s insurer, especially one that arrives in the first days after a crash, is not an act of goodwill. It is a business move designed to close your claim before you know what it is truly worth.

A qualified truck accident attorney can evaluate every category of loss, consult with medical and economic experts, and fight for a settlement or verdict that actually covers your needs. Briskman Briskman & Greenberg handles truck accident cases on a contingency fee basis, meaning you pay no attorney fees unless we recover compensation for you. You may still be responsible for certain case costs, and those details will be clearly explained during your free consultation.

What to Do After a Truck Trailer Detachment Accident in Chicago

The steps you take in the hours and days after a trailer detachment crash directly affect the strength of your legal claim. Evidence disappears fast in truck accident cases, and trucking companies move quickly to protect themselves.

Call 911 immediately and get medical attention, even if you feel okay. Some injuries, including internal bleeding and traumatic brain injuries, do not show obvious symptoms right away. A medical record created at the scene also creates a clear connection between the crash and your injuries.

Document everything you can at the scene. Take photos of the detached trailer, the point of separation, the road surface, and all vehicles involved. Get the names and contact information of any witnesses. Note the truck’s DOT number and carrier name if visible. If the crash happened near Millennium Park, along Lake Shore Drive, or in the Loop, there may be city surveillance cameras that captured the event. Your attorney can seek that footage before it is overwritten.

The practical reason for acting promptly goes beyond the filing deadline. Trucking records can disappear, witnesses can become harder to locate, vehicles can be repaired, and electronic information may be overwritten. The earlier an investigation begins after a serious commercial truck accident, the greater the opportunity to preserve evidence concerning what happened and who was responsible.

Do not give a recorded statement to any insurance company before speaking with an attorney. Illinois gives injured victims two years to file a personal injury lawsuit. Under 735 ILCS 5/13-202, personal injury actions must be filed within two years of the date the injury occurred. However, waiting until the deadline is dangerous. Contact a truck accident lawyer as soon as possible after the crash.

FAQs About Chicago Truck Trailer Detachment Accidents

How is a truck trailer detachment accident different from other truck crashes?

In most truck accidents, the cab and trailer stay connected throughout the crash. In a trailer detachment accident, the trailer physically separates from the tractor and becomes an independent hazard on the road. This creates a uniquely dangerous situation because the trailer can slide, spin, or roll into multiple lanes of traffic before coming to rest. The legal investigation is also different because it focuses heavily on the coupling mechanism, maintenance records, and inspection history, in addition to the driver’s conduct.

Can I sue the trucking company if the trailer’s coupling was defective from the factory?

Yes, and you may be able to sue both the trucking company and the parts manufacturer. If the fifth-wheel coupling or another component was defective when it left the factory, the manufacturer can face a product liability claim separate from any negligence claim against the carrier. Illinois allows you to pursue multiple defendants at the same time, and your attorney will investigate every potential source of liability to maximize your recovery.

What evidence is most important in a trailer detachment accident case?

The most critical evidence includes the truck’s maintenance and inspection records, the driver’s pre-trip inspection logs, electronic logging device (ELD) data, the physical coupling components themselves, and any surveillance or dashcam footage from the scene. Post-crash drug and alcohol testing results are also important. Trucking companies are required under 49 CFR Part 396 to keep detailed maintenance records, and those records can show whether the coupling was flagged for repair and ignored. Acting quickly to preserve this evidence is essential.

What if the detached trailer hit my car but kept moving and I never got the carrier’s information?

A trailer that separates from its cab still carries identifying information, including DOT numbers, company markings, and license plate data on both the trailer and the tractor. Law enforcement responding to the scene will typically gather this information. If you did not get it yourself, a police report from the responding officers will include it. Your attorney can also use traffic cameras and witness accounts to identify the carrier. Even in complicated situations, there are usually ways to identify the responsible party.

How long do I have to file a trailer detachment accident lawsuit in Illinois?

Under the Illinois Code of Civil Procedure, specifically 735 ILCS 5/13-202, most personal injury claims must be filed within two years of the date of the accident. If a family member was killed in the crash, the Illinois Wrongful Death Act, 740 ILCS 180/2, gives surviving family members two years from the date of death to file. These deadlines are firm, and missing them generally means losing your right to recover any compensation. Do not wait to contact an attorney. The sooner you act, the better your chances of preserving the evidence needed to win your case.
