The Distracted Driving Problem in Illinois Is Serious

Distracted driving is not just a bad habit. It is a public safety crisis. Illinois saw 122 fatalities in 2024 due to distracted driving. That number represents real people, real families, and real communities affected by crashes that did not have to happen. Rockford, the second-largest city in Illinois, sits along busy corridors like I-90, US-51, and IL-173. These roads see heavy commercial and commuter traffic every day, and distracted drivers on these routes create serious risks for everyone around them.

Eight percent of fatal crashes, an estimated 13% of injury crashes, and an estimated 13% of all police-reported motor vehicle traffic crashes in 2023 were reported as distraction-affected. Think about what that means for a city like Rockford, where drivers pass through the Coronado District, cross over the Rock River, and merge onto high-speed expressways daily. One glance at a phone can change everything.

The use of a cell phone while driving increases your chance of getting into a crash by 400%. That is not a small risk. The act of glancing at a phone for just 5 seconds while traveling at 55 mph means that the driver drove the entire length of a football field blind, with no awareness of what was happening around them. If a distracted driver hit you, the law is on your side. The team at Briskman Briskman & Greenberg is ready to help you pursue the compensation you deserve.

Illinois Laws on Distracted Driving

Illinois has clear laws that prohibit distracted driving. Understanding those laws matters when you are building a personal injury claim. By Illinois law, distracted driving, including using your cell phone or any other “electronic communication device” while driving a car, is illegal in most cases. “Electronic communication devices” means cell phones, laptops, and other portable electronics.

The law, found at 625 ILCS 5/12-610.2, goes further than just banning texting. This law makes it illegal to drive a car while using an electronic communication device, like a cellphone or tablet, to stream video, participate in any type of video conferencing (like Zoom or Microsoft Teams), and even access any social media site while operating a motor vehicle. These rules took effect on January 1, 2024, and they apply to all Illinois drivers.

The consequences for breaking this law are serious. A person convicted of violating the aggravated use subsection commits a Class A misdemeanor if the violation resulted in great bodily harm, permanent disability, or disfigurement to another. A person convicted of violating that subsection commits a Class 4 felony if the violation resulted in the death of another person. When a driver breaks this law and injures you, that violation becomes powerful evidence in your civil claim. A Chicago personal injury lawyer at Briskman Briskman & Greenberg can use that evidence to build a strong case on your behalf.

Illinois also requires all drivers to carry liability insurance under 625 ILCS 5/7-601. This means that if a distracted driver caused your crash, there is likely an insurance policy that must respond to your claim. Our team knows how to deal with insurance companies and how to push back when they try to minimize what you are owed.

What Happens After a Distracted Driving Crash in Rockford

The moments after a crash are chaotic. You may be in pain, confused, or in shock. Knowing your rights and your obligations under Illinois law can protect you. Under 625 ILCS 5/11-401, the driver of any vehicle involved in a crash resulting in personal injury must immediately stop at the scene or as close as possible, and must remain there until the legal requirements are fulfilled. If the other driver fled, that is a serious criminal matter. A Class 4 felony applies for failing to stop, and a Class 2 felony applies for failing to report when the crash does not result in death. Our attorneys know how to handle hit-and-run situations and can help you explore all available options for recovery.

After a crash near Rockford landmarks like the Nicholas Conservatory, Auburn Street, or the East State Street corridor, here is what you should do. Call 911 immediately. Get medical attention, even if you feel fine. Some injuries, like whiplash, internal trauma, or concussions, may not appear immediately. Early medical evaluation ensures proper treatment and creates documentation that may be critical for insurance claims or legal action. Take photos of the scene, the vehicles, and any visible injuries. Get the other driver’s information. Then call Briskman Briskman & Greenberg. The sooner we get involved, the better we can protect your rights and preserve the evidence in your case.

Illinois also has a statute of limitations you need to know about. For personal injury claims, you generally have two years from the date of the crash to file a lawsuit. For property damage, 735 ILCS 5/13-205 gives you five years. Missing these deadlines can mean losing your right to recover anything. Do not wait to get legal help.

Who Can Be Held Responsible for Your Injuries

The distracted driver is the obvious party in most cases. But Illinois law allows you to look beyond just the driver. Depending on the facts, other parties may share responsibility. Under 735 ILCS 5/2-1117, all defendants found liable are jointly and severally liable for a plaintiff’s past and future medical and medically related expenses. Any defendant whose fault is 25% or greater of the total fault is jointly and severally liable for all other damages too. This matters because it means you may be able to recover your full losses even if one defendant cannot pay.

For example, if a delivery driver was distracted while working a route through Rockford’s Midtown area or along Business 20, the employer may also be liable. Companies have a duty to enforce safe driving policies for their employees. If a commercial driver caused your crash, the company that employed them could share responsibility. Similarly, if a vehicle defect contributed to the crash, the manufacturer may be a defendant as well.

In cases where a distracted and intoxicated driver caused the crash, Illinois law under 235 ILCS 5/6-21 (the Dram Shop Act) may also allow a claim against the establishment that served the driver alcohol. The law places liability on licensed sellers of alcohol who cause the intoxication of a person who then injures someone else. These cases are time-sensitive. The Dram Shop Act requires that actions be commenced within one year after the cause of action accrued. Briskman Briskman & Greenberg understands how to identify all responsible parties and pursue every available avenue of recovery for our clients.

What Compensation Can You Recover

A distracted driving crash can turn your life upside down. Medical bills pile up fast. You may miss work for weeks or months. You may face a long recovery that affects your relationships, your career, and your daily routine. Illinois law allows injured victims to seek compensation for all of these losses. Knowing what you may be entitled to is an important first step.

You can seek compensation for past and future medical expenses, lost wages, loss of earning capacity, pain and suffering, emotional distress, and property damage. If a loved one was killed in a distracted driving crash, the Illinois Wrongful Death Act (740 ILCS 180) allows surviving family members to bring a claim for pecuniary losses, including loss of financial support and loss of companionship. These cases are deeply personal, and the team at Briskman Briskman & Greenberg treats them that way.

Driver inattention is a factor in more than 1 million crashes in North America annually, resulting in serious injuries, deaths, and an economic impact that some experts say reaches nearly $40 billion per year. The financial toll on individual victims can be devastating. Medical care, rehabilitation, and lost income add up quickly. Our attorneys work hard to make sure you are not left holding the bill for someone else’s negligence. We take distracted driving cases on a contingency fee basis, which means you pay nothing unless we recover compensation for you.

FAQs About Rockford Distracted Driving Accident Claims

What qualifies as distracted driving under Illinois law?

Illinois law under 625 ILCS 5/12-610.2 prohibits using any electronic communication device while operating a vehicle. This includes texting, browsing the internet, using social media, streaming video, and participating in video calls like Zoom or FaceTime. Even using a phone at a red light can count as a violation under Illinois law. Other forms of distraction, like eating, grooming, or reaching for objects, can also support a negligence claim even if they do not trigger a specific statute.

How long do I have to file a distracted driving injury claim in Illinois?

In Illinois, you generally have two years from the date of your accident to file a personal injury lawsuit. For property damage claims, the statute of limitations under 735 ILCS 5/13-205 is five years. If the crash resulted in a death, the Wrongful Death Act has its own deadlines. Waiting too long can cost you your right to recover anything. Contact Briskman Briskman & Greenberg as soon as possible after your crash so we can protect your claim from the start.

Can I still recover compensation if I was partly at fault for the crash?

Yes, in many cases. Illinois follows a modified comparative fault rule. Under this system, you can recover damages as long as you are not more than 50% at fault for the crash. Your total compensation is reduced by your percentage of fault. So if you were found 20% at fault and your damages total $100,000, you would recover $80,000. An attorney can help you build the strongest possible case to minimize any finding of fault against you and maximize your recovery.

What should I do if the distracted driver who hit me does not have insurance?

Illinois requires all drivers to carry liability insurance under 625 ILCS 5/7-601. If the at-fault driver was uninsured or underinsured, you may be able to make a claim under your own uninsured or underinsured motorist coverage. You may also have other options, such as pursuing the driver personally or identifying other responsible parties like an employer. Briskman Briskman & Greenberg can review your specific situation and help you find every available path to recovery.

Do I need a lawyer for a distracted driving accident claim in Illinois?

You are not required to hire a lawyer, but having one on your side makes a real difference. Insurance companies have teams of adjusters and attorneys working to pay you as little as possible. An experienced personal injury attorney knows how to investigate the crash, gather evidence of distraction (like phone records), calculate the full value of your damages, and negotiate aggressively on your behalf. Briskman Briskman & Greenberg handles these cases on a contingency fee basis, so there is no cost to you unless we win your case.
