Illinois’ primary law for nursing home residents is the Nursing Home Care Act (210 ILCS 45), which spells out resident rights and provides a private right of action, meaning you can sue, if those rights are violated, and the Act also allows successful residents to recover their actual damages plus their costs and reasonable attorneys’ fees.

The Illinois Nursing Home Care Act explicitly protects residents’ rights to dignity, respect, and safety, discrimination based on a person’s mental health or age is prohibited, and all residents have the right to be treated with respect by all employees and professionals providing health care services.

Illinois also updated its staffing requirements. The Illinois Nursing Home Care Act and related regulations set minimum direct-care staffing ratios, including 3.8 hours of nursing and personal care per day for residents needing skilled care and 2.5 hours per day for residents needing intermediate care. Although the federal government repealed its minimum staffing rule effective February 2, 2026, Illinois state law still requires minimum staffing levels under the Illinois Nursing Home Care Act, and facilities throughout Illinois must continue to comply with state staffing rules and can be penalized for violations.

Starting in 2026, Illinois added even more protections. Public Act 103-1069 strengthens protections for Illinois nursing home residents by amending the Nursing Home Care Act, effective January 1, 2026. Under the new law, every year facilities must provide residents and their next of kin with a written summary of their right to be free from retaliation, how to file a complaint, and the legal remedies available, and all staff members must undergo annual retaliation prevention training.
