What Can I Get For My Neck Injury From My Car Accident?

Impacts from a car accident can cause minor to severe injuries to the drivers and passengers in the vehicles involved. Different types of vehicle accidents can cause damage to certain parts of the body. People involved in a car accident may suffer pain and injuries that are temporary, long-lasting, life-altering, or permanent. Neck injuries also are common in automobile collisions. The impact can jolt a person back and forth and cause injury to the muscles, joints and nerves in the neck and spine. The injured person may suffer from whiplash, stiffness, numbness, fractures, spine and spinal cord damages, or paralysis.

The at-fault driver is liable for the victim’s neck injuries in the car accident. The injured victim may seek compensation from the driver and the driver’s insurance by filing an insurance claim or lawsuit. Under Illinois law, automobiles registered in the state must have liability insurance with the minimum amounts required for bodily injury or death and property destruction.

The victim may recover economic and noneconomic damages for her neck injury. Economic damages are the financial losses the injured party suffered, such as lost wages, property damages and medical expenses, which have exact amounts. Noneconomic damages do not have calculable amounts. Such losses are pain, suffering, loss of enjoyment of life, loss of companionship, humiliation, disability and disfigurement.

Depending on the severity or intention of the motor vehicle accident, the at-fault may also have to pay punitive damages to the victim. The purpose of the damages is to punish the at-fault party for harmful and dangerous behavior. The victim must prove that the at-fault driver’s actions were intentional or indifferent to the risks. Punitive damages are compensation in addition to actual damages (combined total of economic and noneconomic damages). State law limits the punitive damages the victim can receive, which cannot exceed three times the actual damages.
