Chicago parents sue doctors for son’s wrongful death from cancer

The parents of a Chicago cancer victim filed a wrongful death lawsuit against the doctors who treated him, claiming they failed to uphold strict medical standards and provide proper care.

Freddie Villacci and Jennifer Villacci filed the claim in Cook County Circuit Court on February 3 as independent administrators of their son’s estate. Dr. John Joyce, Dr. John F. McFadden, Advanced Radiology Consultants and Suburban Pediatrics LTD were named the defendants.

According to the lawsuit, their son went to see Joyce regarding a mass on his right leg in August 2008. McFadden and Advanced Radiology also examined him on the same day for imaging purposes. However, the claim asserted Advanced Radiology had failed to tell the parents that McFadden was not an agent, employee or staff member of their center. Joyce is allegedly a general medical and pediatric care physician.

Vincent Villacci died on June 9, 2010, after remaining under the defendants’ care from August 2008 to May 2, 2009. His parents claimed both doctors failed to diagnose his cancer and were negligent in providing him with the required medical treatment. McFadden allegedly told the Villaccis that the mass on their son’s right leg was a hemangioma, a benign tumor of blood vessels. The couple is seeking a jury trial and damages in excess of $50,000 as well as court costs.
